RULES AND REGULATIONS FOR OWNERS, RESIDENTS, and GUESTS
OF SOUTHBAY CONDOMINIUM ASSOCIATION
INTRODUCTION:
This handbook has been designed for owners, residents, and guests of Southbay Condominiums.
These rules have been compiled with careful consideration for the safety of our condominium community at Southbay.
Condominium life and being part of a community requires some guidelines as provided for in our Declaration of Condominiums, Rules and Regulations, and By-Laws as recorded in Pinellas County, Florida.
ADMINISTRATION:
The Board of Directors is elected by the unit owners in accordance with the Association Bylaws and the Florida Statutes Condominium Act. The Board is responsible to the unit owners for the effective management of the Association operations, finances and all other Association activities within a safe living environment. The Property Manager is responsible for the overall administration of the daily operations and maintenance of our property and buildings. This also includes communications with Board Members and owners alike. The manager is responsible to the Board of Directors of Southbay Condominiums as deemed at the annual elections voted on by the owners. The Management Office is located adjacent to the Clubhouse and is open from 8:30-4:30 weekdays.
Official information and important announcements may be found at the bulletin boards located at each mailbox location.
It is the responsibility of the manager to enforce rules and follow-up on complaints and suggestions. It is recommended that this subject matter be put into writing and directed to the manager.
General requests should be communicated through a “work request” form which can be found in the clubhouse. Any request can also be phoned in and / or e-mailed to the manager.
Southbay also has a web site as a means of communication with our residents. It contains meeting agenda, meeting minutes, manager reports, board member roster, e-mail the manager, and more. We can be located on-line at: www.southbaystpete.com
HOUSE RULES:
OCCUPANCY – Occupancy of each unit is limited to a single family. A family is defined as one or more persons related by blood, marriage, or adoption –or- no more than two unrelated persons living together in a unit. County ordinance states the following for long-term residence:
1 bedroom = 3 persons, 2 bedrooms = 4 persons, 3 bedrooms = 6 persons.
HOUSE GUESTS – The Management Office must be informed when a house guest(s) is to occupy a unit during the absence of an owner. Guests must complete a guest application and certify receipt of a copy of the rules and regulations. Houseguests are not permitted to bring pets into Southbay unless approved by the Board.
LEASING UNITS- The unit must be owned for no less than one calendar year to be eligible to be a rental unit. No unit may be rented more than three (3) time periods in one calendar year and no less than 90 days each. The OWNER is responsible to inform the manager of the rental and an application, interview, and approval must be completed and filed with the association prior to moving in. Interviews will be conducted by members of the Board of Directors and recommendations will be provided to the Property Manager. Owners relinquish their rights to use Southbay facilities and common areas when their unit is being rented.
USE OF UNITS –
1. Decoration: No unit owner shall decorate any part of a unit or the building as to change the appearance of the building from the exterior. This includes the painting of any balconies, permanent illumination of the exterior of the building, display of hanging plants or other objects upon balconies, railings, window sills, and ledges; unless approved by the Board of Directors.
2. Equipment Failure: Equipment shall be used only for the purpose it is intended for. Failure of any equipment shall be reported immediately to the management, regardless of the responsible party. In order to assure that proper precautions have been taken to avoid damage to other equipment. Each unit owner shall be liable for all damage caused by misuse of equipment by owners/residents/guests of the unit.
3. Fire Hazards: No article shall be stored nor any use made of any part of the condominium property that will constitute a fire hazard. Use caution when cleaning/dusting sprinklers in tower unit ceilings. Hanging objects from sprinklers or painting over them is absolutely not permitted. Owners are reminded that they will be assessed for any increase in the cost of insurance beyond the scope of our residential master/flood policies; that is caused by their use of the property.
4. Installations: Only such awnings, blinds, shades and sunscreens shall be used on balconies or windows as are furnished/approved by the association. Storm shutters that are permanently secured to the building year round are required to be white.
EMERGENCY/OUT OF TOWN ARRANGEMENTS –
UNIT OWNERS ARE REQUIRED TO FURNISH THE ASSOCIATION WITH KEYS TO THEIR UNITS FOR EMERGENCY PURPOSES AS REQUIRED BY FLORIDA LAW. These keys are stored in a secure location in a safe box. It is recommended that the water to your unit is shut off when out of town. In addition, emergency contact information, email address (if applicable) and contact information of individuals with unit access (neighbors, family members etc.) should be provided to the office manager to assist in emergent situations.
BALCONIES/PORCHES - No items (clothing, rugs, towels, etc.) shall be permitted to hang from balcony railings, windows, and/or balcony furniture. No hanging plants, refrigerators, coolers, cabinets, stoves, bikes, or any household items are permitted on balconies (this includes villas with screened encl.) By order of Fire Code – no gas grills are allowed above the first living floor of any building. Electrical grills, however, are allowed.
MAINTENANCE AND REPAIR - Unit owners are reminded that the maintenance and repair of the buildings is the responsibility of the association (common areas) with the exception of the interior of the units. As authorized by the Declaration of Condominiums and the Board of Directors; the maintenance, repair, and replacement, of windows and glass doors shall be the responsibility of the unit owner, except in the case of severe damage for which insurance proceeds are available. No work of any kind is to be done upon the part of the building to be maintained by the Association without first obtaining the approval required by the Declaration of Condominiums. Regardless of the party responsible for the maintenance and repair, it is recommended that the need for such work be reported to the association office.
NOISE – As a consideration to your neighbors and guests all unnecessary or rowdy noise is to be avoided from 11:00 p.m. until 8:00 a.m. In order to assure the comfort and peace of all residents, the playing of any music, television, musical instruments, and any related noise, which can be disturbing; shall be kept at a reasonable volume which cannot be heard outside of the unit itself.
MOVING AND CONTRACT WORK All moving in/out and contract work must be completed between 9 a.m. and 5 p.m. Moving & contract work is limited to Monday-Saturday. Loud construction work/demolition may not begin until 10 a.m. No moving, contract work or loud construction work/demolition is permitted on Sundays.
FLOORING – Unit owners are reminded that as an aid to noise control, the Declaration of Condominium requires all flooring with the exception of bathrooms, kitchens, and laundry rooms; be covered with wall to wall carpeting or that a sound barrier be placed beneath any other type of flooring (tile, wood, etc.) to prevent the transmittal of sound to adjoining units. It is required that cork board or similar noise reducing silent/sound blocking product must be used and proof be made available to the association prior to install.
SIGNS – Unit owners may identify the unit number by name plate of a type and size approved by the association. No other sign may be placed outside of unit, in windows, or anywhere on the property.
WINDOWS - In order to avoid water damage to units and to other parts of the building, it is required that all doors and windows exposed to the elements are to be closed when no one is in the unit. Failure to close windows and doors will render the owner liable for any resulting damage.
ANTENNAS – No radio, television, or antenna for any device or wiring for any device may not be installed on the exterior of the building or on the railings without written consent of the Association.
TRASH DISPOSAL – No pet waste or non-bagged/tied garbage is to be placed in the trash chutes or dumpsters. NO GLASS is to be placed in trash chutes. Bottles, dishes, newspaper, pet waste (cat litter) are to be bagged and carried to the dumpsters located on the garage level of the hi-rise buildings. ALL BOXES, CARTONS AND PACKING MATERIALS MUST BE BROUGHT TO THE DUMPSTER ROOM AND BROKEN DOWN PRIOR TO PLACEMENT IN THE DUMPSTERS. For other items not meant for the dumpster (furniture, etc.) the city should be contacted for sites within the city that collect these items. No furnishings, carpet, etc. are ever allowed to be left outside dumpster rooms.
BIRD FEEDING – Birds are not to be fed from balconies or anywhere on site.
CHILDREN – Children under 12 years of age must be supervised by an adult at all times. Parents or any other adult responsible for the supervision of a child, are accountable for complying with the Association’s Rules and Regulations.
AUTOMOBILES – Automobiles must be parked IN THE SPACES DESIGNATED. Reserved spaces may not be borrowed without the written permission from the owner and a copy of the designation provided to the Southbay manager. Guests should only use the ‘guest spaces’. Cars parked in reserve spaces or in no parking zones will be towed at owner’s expense. All vehicles are required to have current license plates and up to date registration. Spaces may not be rented as they are a limited common area.
PARKING – Commercial vehicles, motorcycles, motorbikes, and skate boards are prohibited. Campers, RV’s, Portable on Demand (PODS) units, and Boat Trailers are limited to only 24 hour parking on the property within a seven day period. They may not obstruct traffic or emergency vehicle areas. Violators will be towed at owner’s expense. No mechanical repairs to any type of vehicles are permitted on the property – except for emergency repairs.
CAR WASH – Cars may be washed between 8:00 a.m. and 7:00 p.m. The car wash is for the use of residents only. No music of any kind may be played without earphones. Please shut-off water and return hose when finished.
BICYCLES – Bike racks are provided in both parking garages and may be used at your own risk. Bicycles may not be stored on balconies and porches. Bikes should be labeled with unit number for identification purposes. It is strongly recommended that owners lock bikes to avoid theft.
SKATEBOARDS, ROLLERBLADES, AND RECREATIONAL SCOOTERS - Use of skateboards, rollerblades, and recreational scooters are not permitted on Southbay property. Please use walking/riding trail adjacent to Southbay.
PET POLICY – Pets must not weigh more than 25 pounds and are limited to 2 domestic animals per unit. Pets must be on a leash at all times (State Law). At the discretion of the Board of Directors, permission to keep an animal may be revoked at any time. Pets are never allowed on the pool deck as defined by Health Code 64E-9.
PET WASTE - Must be picked up by the owner and disposed of. Pet Walk area is along the trail /entrance road only.
BOARD MEETINGS – Are held monthly on the third Thursday of each month at 7 p.m. in the Clubhouse. Summer time meetings may not occur monthly. Information on the meetings is always posted on the bulletin boards for your convenience. The Annual Board Meeting and Elections are always held on February 20th of each year in the clubhouse – information packets/notices are mailed/hand-delivered to each owner.
MAINTENANCE PAYMENTS/REQUESTS – May be placed through the mail slot accessible from the Clubhouse, mailed, or dropped off to the office manager in person.
TOWER BUILDINGS 7430 AND 7432
HALLWAY DOORS - are never to be left open IN THE TOWER BUILDINGS. This is a safety regulation from the Fire Department. All doors are required to have self-closing mechanisms.
COMMON AREAS - It is your responsibility to leave all common areas (elevators, mailrooms, lobby, sidewalks, stairwells, and hallways) clean at all times when moving or remodeling. Children are not permitted to play in the halls, garages, elevators or on fire stairs.
STORAGE ROOMS - Personal items shall NOT be stored in the hallways or outside the assigned storage locker, trash chute rooms or electrical rooms.
SHOPPING CARTS – Carts are for the use of Southbay residents only and should not be used by contractors! All carts MUST BE RETURNED to the mailrooms as soon as possible after use. Please be sure not to leave in elevators.
ELEVATORS – Help keep elevators safe. Wipe up waste immediately to avoid injury. Unit owners are responsible for any debris caused by (but not limited to) contractors hired for work within their unit. Any moving or remodeling where items will be loaded/unloaded off elevators requires padding to be placed within the elevator – please contact the association office to obtain padding to be placed in elevators.
NO SMOKING – Smoking is not permitted in the elevators, halls, lobby, clubhouse, or within any interior common areas of the building. This is a Fire Marshall requirement and can lead to fines and prosecution.
OVERHEAD CLEARANCES – The parking garages of each building have a height limitation. Please be aware of this and drive with caution when using oversized vehicles. Any damage to the parking garage is the owner’s responsibility. Please observe a safe speed in parking areas at all times.
SWIMMING POOL RULES -
THERE IS NO LIFEGUARD ON DUTY – ALL PERSONS MAY USE POOL AT THEIR OWN RISK
1. Pool use is limited to Southbay Residents and their guests only. Visitors should be accompanied by the resident at all times.
2. Maximum pool load is 25 people at a time.
3. Hours of Operation are from 8 a.m. to Dusk, except when closed for maintenance.
4. Swimming attire must be worn at all times when in the pool.
5. Shower prior to entering pool to remove suntan lotions, creams, and oils.
6. Use towels on furniture.
7. Beach cover up and shoes must be worn going to and from the pool. Bathing suits must be dry when entering the buildings.
8. Children twelve and under must be supervised by an adult at all times.
9. No-Leak Swim pants must be worn by all incontinent children and adults as required by State Law.
10. Running, horseplay or excessive noise is not permitted at any time.
11. Sports equipment, not limited to, balls, Frisbees, etc. is not permitted.
12. Food and drinks are not allowed within 4 feet of the pool edge.
13. Glass or breakable containers are not allowed.
14. Pets are not allowed in pool or on pool deck area as stated in Health Code #64E-
15. Bird feeding is prohibited in pool area.
16. Music may be played with discretion. Please be considerate of others.
FISHING PIER / DOCK RULES -
1. Hours are from 7 a.m. to 11 p.m.
2. Use is limited to Southbay Residents and guests only. Visitors should be accompanied by the resident at all times.
3. Boats may dock on the sides or head of the dock for no more than 24 hours in a seven day period.
4. No excessive noise or horseplay allowed. .
5. No diving from the pier is allowed.
6. NO Glass or breakables allowed.
7. Children twelve and under must be supervised by an adult all times.
8. The fish cleaning area must be cleaned thoroughly after use.
CLUBHOUSE / RECREATION ROOM / GRILL –
1. HOURS of availability - from 8 a.m. to 11 p.m. (1 a.m. on New Year’s Eve)
2. Holidays are reserved for use by the association only.
3. The room and grill must be left clean and in the same condition as found including garbage removal. Cleaning supplies/bags are located under the sink and in the closet.
4. Smoking is not permitted inside the clubhouse.
5. Furnishings and other items may be borrowed from the recreation room or patio with Board Approval.
6. The clubhouse may be reserved by residents in advance for parties. Please note that the clubhouse must always be available for owner access even when reserved per association document requirement. Unless otherwise advised, the recreation room is reserved for the condominium association on all Holidays.
7. Please notify the manager if grill tanks have been depleted after use.
8. Owners can be assessed to repair any damage to the clubhouse / common areas.

HALLWAY DOORS - are never to be left open IN THE TOWER BUILDINGS. This is a safety regulation from the Fire Department. All doors are required to have self-closing mechanisms.
COMMON AREAS - It is your responsibility to leave all common areas (elevators, mailrooms, lobby, sidewalks, stairwells, and hallways) clean at all times when moving or remodeling. Children are not permitted to play in the halls, garages, elevators or on fire stairs.
STORAGE ROOMS - Personal items shall NOT be stored in the hallways or outside the assigned storage locker, trash chute rooms or electrical rooms.
SHOPPING CARTS – Carts are for the use of Southbay residents only and should not be used by contractors! All carts MUST BE RETURNED to the mailrooms as soon as possible after use. Please be sure not to leave in elevators.
ELEVATORS – Help keep elevators safe. Wipe up waste immediately to avoid injury. Unit owners are responsible for any debris caused by (but not limited to) contractors hired for work within their unit. Any moving or remodeling where items will be loaded/unloaded off elevators requires padding to be placed within the elevator – please contact the association office to obtain padding to be placed in elevators.
NO SMOKING – Smoking is not permitted in the elevators, halls, lobby, clubhouse, or within any interior common areas of the building. This is a Fire Marshall requirement and can lead to fines and prosecution.
OVERHEAD CLEARANCES – The parking garages of each building have a height limitation. Please be aware of this and drive with caution when using oversized vehicles. Any damage to the parking garage is the owner’s responsibility. Please observe a safe speed in parking areas at all times.
SWIMMING POOL RULES -
THERE IS NO LIFEGUARD ON DUTY – ALL PERSONS MAY USE POOL AT THEIR OWN RISK
1. Pool use is limited to Southbay Residents and their guests only. Visitors should be accompanied by the resident at all times.
2. Maximum pool load is 25 people at a time.
3. Hours of Operation are from 8 a.m. to Dusk, except when closed for maintenance.
4. Swimming attire must be worn at all times when in the pool.
5. Shower prior to entering pool to remove suntan lotions, creams, and oils.
6. Use towels on furniture.
7. Beach cover up and shoes must be worn going to and from the pool. Bathing suits must be dry when entering the buildings.
8. Children twelve and under must be supervised by an adult at all times.
9. No-Leak Swim pants must be worn by all incontinent children and adults as required by State Law.
10. Running, horseplay or excessive noise is not permitted at any time.
11. Sports equipment, not limited to, balls, Frisbees, etc. is not permitted.
12. Food and drinks are not allowed within 4 feet of the pool edge.
13. Glass or breakable containers are not allowed.
14. Pets are not allowed in pool or on pool deck area as stated in Health Code #64E-
15. Bird feeding is prohibited in pool area.
16. Music may be played with discretion. Please be considerate of others.
FISHING PIER / DOCK RULES -
1. Hours are from 7 a.m. to 11 p.m.
2. Use is limited to Southbay Residents and guests only. Visitors should be accompanied by the resident at all times.
3. Boats may dock on the sides or head of the dock for no more than 24 hours in a seven day period.
4. No excessive noise or horseplay allowed. .
5. No diving from the pier is allowed.
6. NO Glass or breakables allowed.
7. Children twelve and under must be supervised by an adult all times.
8. The fish cleaning area must be cleaned thoroughly after use.
CLUBHOUSE / RECREATION ROOM / GRILL –
1. HOURS of availability - from 8 a.m. to 11 p.m. (1 a.m. on New Year’s Eve)
2. Holidays are reserved for use by the association only.
3. The room and grill must be left clean and in the same condition as found including garbage removal. Cleaning supplies/bags are located under the sink and in the closet.
4. Smoking is not permitted inside the clubhouse.
5. Furnishings and other items may be borrowed from the recreation room or patio with Board Approval.
6. The clubhouse may be reserved by residents in advance for parties. Please note that the clubhouse must always be available for owner access even when reserved per association document requirement. Unless otherwise advised, the recreation room is reserved for the condominium association on all Holidays.
7. Please notify the manager if grill tanks have been depleted after use.
8. Owners can be assessed to repair any damage to the clubhouse / common areas.
